Notes on Labor/Management MeetingsApril 13, 2006 Present: Jim Dix, Fran Goldman, Dennis Selzner, Joe Schultz, Darryl Wood, Ann Glossl, Sylvia Hall, Beth Kilmarx. Timeline for PCB Ballast Removal . UUP inquired about the timeline for checking and replacement of light fixtures containing PCB in ballasts. Management responded that there was no specific update, and that more information would be forthcoming in “a month or two” about a timeline for PCB removal. There have been some management changes, including the hire of a new compliance officer. Parking in Downtown Center . UUP inquired about the policies that will be in place for parking in the Downtown Center . Management said that there would be 130 parking spots on the property. No decisions have been made on who can park there, and the administration is still trying to clarify who will occupy the center. UUP reminded Management that the UUP-State contract specifies that the number of parking spots available for UUP members cannot decrease. UUP stated that it is UUP's understanding that parking at the Innovative Technologies Complex is considered “on campus” parking, that parking at the Downtown Center will also be considered “on campus” parking, and that parking at these “on campus” locations would be governed by the current parking policies. Strategic Plan Metrics . UUP requested an update on the metrics the administration would be using to gauge progress on the goals of the University's Strategic Plan. Management said that as information becomes available it will be made public. Some information will be available at the end of summer. The metrics in the VP Administration division will be made available on the Web. Management commented that the Strategic Plan has “real life.” Development of metrics in the academic divisions has not been a top priority as of yet. Pedestrian Safety . UUP inquired about the progress Management has made in enforcing regulations banning driving vehicles on sidewalks on campus. Management replied that regulations have been developed and they were working on getting the information out. The University Police will enforce the regulations, with a formal communication to the campus community by summer, and probably earlier. Management said they would send UUP a copy of the policy on driving in the interior of campus. Management also updated UUP on other steps they have taken to improve pedestrian safety: installation of movable signs in crosswalks; four additional speed indicators; experiments with different colors for crosswalk indicators. Management reported that from 2004 to 2005 the University Police increased the number of misdemeanor traffic tickets from 52 to 104 (misdemeanor traffic tickets are more serious than the more common violation traffic tickets). It was not clear whether the increase was in increase in the number of serious traffic infractions, or in the degree of enforcement of existing serious traffic infractions. Discretionary Salary Increases . UUP stated that the information about the DSI salary increase for this year will be put on the UUP website next week, and an email will be sent to UUP members informing them of the web site link. Management requested that Human Resources not be listed as a contact for inquiries about factual errors in the web pages. UUP will take HR's concerns into account in revising the web pages. Plans for Newing and Dickinson residential complexes . UUP asked Management for an update about the status for Newing and Dickinson residence halls on campus. Management replied that a committee has been formed of students, faculty masters, and administration to look into options. The committee has met twice so far, and will continue to meet. Newing and Dickinson are currently not in compliance with various building codes, and that the code issues have to be resolved by 2010. UUP stated that their understanding is that the only options are to renovate, or tear down and build a new building. Tearing down and not building or not providing a replacement building was not an option. Management did not know whether these were the only options being considered, and would get back to UUP to clarify the matter. Article 16 lists . The contract in Article 16 calls for various lists of information to be provided to UUP. Management and UUP differ in the interpretation of Article 16. Dennis Selzner will try to resolve the issue at the State Level. Part-time Leave Accrual Draft Document . UUP had specific concerns about compensatory time, and will forward specific concerns to Management. Undergraduate Enrollment Targets . UUP has heard three enrollment targets: 200 new students for next fall, 1000 new students for the next two years, and 3000 new students at some unspecified time. UUP requested clarification from Management. Management stated that the enrollment target was 15,000 “in the near future” (current enrollment is about 14,000). It was highly unlikely that there would be 500 new students next fall. Management said they could check on the projected enrollments and would report back to UUP. Dual career consortium . Management reported that a “New York State Upstate Regional Higher Education Recruitment Consortium” has been formed to assist in finding places for spouses and significant others of all hires. For example, the spouse of a faculty member hired at Cornell might find a job at BU. Management will send to UUP a list of participating universities and the web site link. EOL Requests . Management stated its desire to obtain copies of requests that UUP members make to their supervisors in requesting Employee Organizational Leave (EOL). UUP agreed to inform individuals of Management's request. Points of contact for labor management issues . Management expressed a desire to be the sole point of contact for UUP inquiries about labor management issues. Sylvia, Dennis, Darryl and Joe will discuss this issue at a separate meeting. Retention Study . Management reported that senior staff was pleased with the faculty/staff retention study (see below). There are no plans to study the retention issue further because of workload issues and a lack of data about why people leave. Social Security Numbers . Management distributed a memorandum from Mark Reed, AVP for Computing, giving an update on the SSN Remediation Committee deliberations. The core change is the development of a new 9-digit “BU ID” that will replace the record key in almost all places where SSNs were used. A draft of the new policy and how it might affect departments and programs is given at http://computing.binghamton.edu/policies/SSN_Remediation_Plan.html and http://computing.binghamton.edu/policies/SSN_Policy.html . The conversion to the BU ID will take place winter break, 2006-2007, or just after commencement in 2007. Compensatory Time for Part-time UUP nonexempt under FLSA . The guidelines under the Fair Labor Standards Act (FLSA) as to who is and is not exempt from having to be paid overtime were changed to an income-first test with duties and responsibilities the second test. Implementation of this guideline at BU for part-time UUP members who work more than their obligation has created situations where they are not paid for time they work [Darryl – can you fill in the case in which this agenda item applies?]. Two ways to implement the guideline are to change their part-time percentage from pay period to pay period, or to increase their salary so the income test is not an issue. Management Confidential to UUP transition . Management has identified 7 employees who are currently classified as Management Confidential but should be in the UUP bargaining unit. The State will consider time in MC as time in the UUP bargaining unit when considering permanent appointment. The change will occur May 4. Management gave UUP a heads-up that some employees are not happy being reclassified from MC to UUP because of perceived benefit and status changes. Retention Study:
